1.Definitions
The following Contract Conditions together with the General Information
contained on the website form the basis of your contract with
Languedoc Gite Maintenance. Please read them carefully as
they set out our respective rights and obligations.
In these Contract Conditions “you” and “your” means
all persons named on the contract (including anyone that is added
or substituted at a later date). “We” and “us” refer
to Languedoc Gite Maintenance.
All contracts are made subject to these Terms and Conditions.
2.Completing your Contract
You must complete a contract before services can commence.
Returning an Email copy of the contract can start the contract
process. An
original signed copy of the contract must be sent by post to
complete the process along with the essential copies of the
required forms
of identification.
3.Payment
Once we have received your contract details and a deposit or
funds in full/standing order we will commence the service and
confirm
to you via Email and invoice. The invoice will be sent to the
contract address. You must check this invoice carefully as
soon as you receive
it. Contact us immediately if any of the information, which
appears, on the invoice is incorrect. You must also check that
the other
documentation is correct. We regret that we cannot accept any
liability if we are not notified of any inaccuracies in any
of the documentation
within 7 working days of our sending it out. In order to
confirm your contract and commence services, payment must be in
Euros and by cheque, allowing 5 full working days to clear or the
setting up of a bank standing order.
4.Governing Law and your Contract
A binding contract between us comes into existence when we
despatch our confirmation invoice to the name on the contract.
French
Law governs this contract and all matters arising out of
it. We both
agree that any dispute arising out of or in connection with
your contract will be dealt with by the Courts of France.
Please note, changes and errors occasionally occur. You must
check the price of your services and total payment at the
time of completing
the contract.
5.Changes by you
Should you wish to make any changes to your confirmed contract,
you must notify us by Email as soon as possible. Whilst
we will endeavour to assist, we cannot guarantee we will be
able to meet
such requests. Where we can, an amendment fee may be payable
together with any costs incurred by ourselves.
6.Cancellation of Contract by you
Should you need to cancel your contract once it has been
confirmed the name on the contract must immediately advise
us in writing.
Your notice of cancellation will only be effective when
we receive it in writing at our office. As we incur costs
from
the time
we confirm your contract, cancellation charges may be
payable.
7.Changes and cancellation by us
Occasionally, we have to make changes to and correct
errors on our website descriptions and other details
both before
and after
contracts have been confirmed.
Whilst we always endeavour to avoid changes and cancellations,
we must reserve the right to do so.
If we have to make a significant change or cancel your
contract, we will inform you as soon as possible.
We will endeavour to offer you alternatives should
significant change or cancellation occurs to your contract.
We regret
we cannot pay any expenses, costs or losses incurred
by you as
a result of
any change or cancellation.
8.Insurance & Liability
It is strongly recommended that you take out adequate
house and contents insurance. Please read your policy
details
carefully. It is your responsibility to ensure that
the insurance covers
your particular needs. Chimneys, flues and gas boilers
must be
cleaned/swept
at least once a year: we may ask you for proof of
this. We are not liable for any losses incurred for your
failure to
make adequate
protection needs.
9.Maintenance Deposit
A maintenance deposit is required from you of €150 at the
signing of the contract to action any urgent maintenance work on
your property. Urgent means where the security of your property
is at risk or where potential damage to your property may be incurred.
These funds will only be used to meet the circumstances stated
above. Any other use of these funds will only be by your direct
consent. The funds/balance of funds are refundable at the end of
the contract period.
10.Force Majeure
We regret we cannot accept liability or pay any
compensation where the performance or prompt
performance of our
contractual obligations
is prevented or affected by or you otherwise
suffer any damage or loss as a result of "force majeure". In these Booking
Conditions, "force majeure" means any event, which we
or the supplier of the service(s) in question could not, even with
all due care, foresee or avoid. Such events may include war or
threat of war, riot, civil strife, actual or threatened terrorist
activity, industrial dispute, natural or nuclear disaster, adverse
weather conditions, fire and all similar events outside Languedoc Gite Maintenance's control.
11.Prices and Website Accuracy
Please note, the information and prices shown
on our website may change from time to time.
Whilst
every
effort is made
to ensure
the accuracy of the website and prices at the
time of completing the contracts, regrettably
errors
do occasionally
occur.
You must therefore ensure you check all of
the details of your
contract including all prices.
